    Mark,

We just sued to block the Trump administration from handing out $1.8 billion in taxpayer funds to his allies who claim to be the victims of government weaponization.

Some brief background: Trump sued the IRS for $10 billion, and created this fund as a settlement for his absurd lawsuit against the agency. The settlement was secretly negotiated by Trump’s personal attorneys and the Department of Justice he controls—a blatant and corrupt conflict of interest.

Mark, this settlement is one of the single most corrupt acts in American history, rewards political violence, and violates our constitutional system of government.

CREW’s new lawsuit is challenging the blatantly illegal slush fund on several grounds:

    • It is unlawfully structured to evade transparency laws including the Freedom of Information Act and the Federal Records Act.
    • The Trump administration failed to follow public notice-and-comment procedures before setting up the massive slush fund.
    • Creating the fund exceeds the DOJ's authority under the Judgment Fund statute.
    • The fund violates the separation of powers by usurping Congress's authority to spend taxpayer money, under the Appropriations Clause.

Beyond the legal issues with the fund, it should be abhorrent to every American that their taxpayer dollars are being used to pay the president's allies who have been charged with crimes. And paying criminals who claim to have been victims of government “weaponization” could embolden them to commit new crimes including acts of political violence.

The White House has even failed to rule out payments to January 6 insurrectionists from the fund—several of whom have gone on to commit serious crimes, including possession of child pornography, burglary and threats against elected officials.

Pardoning the criminals who tried to overturn an election to keep you in power and creating a $1,776,000,000 slush fund for them seems like exactly what you would do if you wanted them to do it again.

This so-called “weaponization” slush fund is an outrage on every level and it cannot stand.

We are committed to shutting it down, and doing so as quickly as possible. We will keep you updated on the lawsuit as it moves forward.
