Last month, the DOJ announced a nearly $1.8 billion fund to compensate President Trump’s allies in the president’s $10 billion lawsuit against his own administration. And then it came out that the settlement also included a deal to protect Trump, his family and his businesses from IRS audits—a massive benefit.

This is an outrageous abuse of power and one of the single most corrupt acts in American history. It rightly faced broad bipartisan outrage and in response, administration officials have repeatedly contradicted one another over how the fund will proceed.

For now, the slush fund is indefinitely shut down—thanks to lawsuits like ours that challenged the fund. But the aspect of the settlement shielding Trump from IRS audits remains.

In light of the administration’s contradictions and hesitation to fully and permanently abandon the slush fund—and continued insistence on protecting Trump from audits—Congress must legislate to ensure it cannot move forward.


Congress cannot condone the president’s efforts to protect and enrich himself and his inner circle. It must legislate to stop this unprecedented and self-serving arrangement from moving forward.

In addition to prohibiting the terms of this settlement, Congress must also prevent future conflicts by prohibiting a sitting president from suing his own administration and collecting damages from it during his term in office.

There must be an investigation into whether the administration’s extraordinary grant of self-immunity violates existing law and Congress must identify the legal gaps that allow this absurd abuse of power.

If Congress does not confront the current administration’s collusive conduct, that would give the green light for more corruption like this to happen again.
