In case you missed it, a federal judge ruled that President Trump is not immune from civil claims that he incited a mob of his supporters to attack the Capitol on Jan, 6, 2021.

AP News: “Trump isn’t immune from civil claims his Jan. 6 rally speech incited riot, judge says”

According to AP News, U.S. District Judge Amit Mehta ruled that Trump’s remarks at his “Stop the Steal” rally, held shortly before the January 6 insurrection, were “plausibly” inciting words and are not protected by the First Amendment right to free speech.

This means that while Trump cannot be held liable for his official acts on January 6, 2021, he can be held liable for his Ellipse speech and many of his social media posts from that day.

This is major news, Mark — especially at a time when Donald Trump is once again trying to rewrite history regarding January 6th.

Last month, the DOJ filed papers seeking to vacate the seditious conspiracy convictions against members of the Proud Boys and Oath Keepers extremist groups, according to NPR.

These individuals had previously received commutations of sentences for their roles in the January 6th attack when Trump returned to office. However, they did not receive full pardons, so the felony convictions remain on their records.

The Trump administration’s claim would have completely wiped out those convictions.

Mark, seditious conspiracy (18 U.S. Code § 2384) means working with a group to "overthrow, put down, or to destroy by force the Government of the US."

By pardoning those who were convicted of doing just that, Trump is sending a clear and dangerous signal: Support for Trump is more important than attempting to overthrow our democracy.

This is a real threat to our democracy.

Again and again, Donald Trump has tried to dodge accountability and wash his hands of his role in the January 6 attack.

We’re not going to let that happen.
