This Thursday, the Senate Judiciary Committee is scheduled to vote on Daniel Domenico, Donald Trump’s nominee for a lifetime seat on the U.S. Court of Appeals for the Tenth Circuit.
His record shows exactly why the Senate must reject him, and why it should oppose every judicial nominee Trump sends forward.
As a federal district judge, Domenico has repeatedly interpreted the law in ways that expand government power and undermine essential protections.
❌ He gave Trump’s immigration officials the power to imprison immigrants already living in the United States without bond, even while acknowledging that no other federal judge in Colorado had interpreted the law that way.
❌ He ordered Colorado to exempt a publicly funded religious preschool from antidiscrimination rules protecting LGBTQ+ people, forcing taxpayers to subsidize discrimination.
❌ He also blocked the state from enforcing a medical safety rule against an unproven medication abortion “reversal” procedure that leading medical experts have called unscientific and unethical.
But this fight is bigger than any one nominee.
Trump has publicly attacked judges for acting independently and said it is acceptable for Supreme Court justices to be loyal to the president who appointed them. His administration has repeatedly defied court orders and threatened judges who rule against it.
A president who demands personal loyalty and resists the authority of the courts cannot be trusted to select the judges responsible for checking his power.
The Senate must draw a line. Not Domenico. Not the next nominee. Not any judicial nominee chosen by Donald Trump.
The Senate Judiciary Committee can stop Domenico’s nomination this Thursday. But senators must also understand that the opposition will not end with him: Trump cannot be allowed to fill the federal courts with lifetime judges chosen to protect his power instead of checking it.
