Here’s some great news: A judge just voided President Trump's settlement with the IRS granting him immunity from audits!
She also referred one of Trump’s lawyers and Department of Justice officials who signed off on the settlement to state bar authorities to determine if their actions violated legal ethics rules.
Trump’s settlement with the IRS was one of the most corrupt acts we’d ever seen from a president.
Trump runs the executive branch, and therefore was on both sides of this litigation. That raised *impossible* constitutional concerns. And the outcome he secured from his own government was outrageous—a $1.8 billion slush fund for his allies and immunity from audits for himself, his family and his businesses.
As the judge just said in the ruling:“This was an attempt to use the Court to provide some legitimacy to an agreement to confer immunity to people and entities affiliated with the President and to earmark billions of dollars from American taxpayers to redress grievances not defined in the law… There was never adverseness between the Parties; there was never a case or controversy; and there was never a question as to who would prevail.”
We laid out the problems with the lawsuit in an amicus brief in this case back in February, making many of the same arguments that showed up in this decision, including a potential Emoluments Clause violation. CREW's Freedom of Information Act requests and past cases were also cited several times in the decision.
This decision is a huge victory for the rule of law.
Anyone who cares about taxpayer resources not going to enrich the president should celebrate this today—and then keep fighting to make sure Trump’s next corrupt scheme does not succeed.
