Mark,
CREW just filed a complaint over Stephen Miller’s comments about the Democratic Party and the midterm elections while appearing on Fox News in his official capacity.
On October 8, 2026, Miller was interviewed by Sean Hannity and was identified as Deputy Chief for Policy and Homeland Security Advisor.

During this interview, Miller said the Democratic Party is “coast to coast” made up of DSA candidates and politicians who won’t condemn them. He spoke specifically of US Senate candidate Abdul El-Sayed in Michigan. He disparaged political candidates, calling them extremists and cowards.
Miller concluded his interview by saying that this election “is the clearest choice you will ever have.”
This is exactly the kind of partisan political activity the Hatch Act is designed to prevent. The law prohibits senior White House staffers from using their official position to interfere in elections. Miller’s partisan comments, delivered in his official capacity, clearly violate the law.
Mark, this is far from the first time Stephen Miller has apparently violated the Hatch Act.
On May 28, 2026, Miller appeared on Fox News and was identified in his official capacity.
When discussing James Talarico’s nomination by the Democratic Party in the US Senate race in Texas, Miller responded with partisan comments, mocking Talarico as "the Democratic Party’s first transgender Senate candidate who is clearly transitioning to female."
He went on to suggest Texans would reject Talarico in favor of Ken Paxton, whom he described as a "real conservative, patriotic, god-fearing" leader.
CREW filed a complaint against Miller for these partisan and bigoted comments that were delivered in his official capacity—clearly violating the law.
However, the Office of Special Counsel has yet to resolve our complaint.
Now, we’ve filed a second complaint against Miller as he continues to violate the Hatch Act by disparaging political candidates and calling them extremists and cowards.
The Hatch Act exists to protect the integrity of our government from partisan abuse. When senior White House officials—like Miller—appear to disregard the law without consequences, it sends a dangerous message to everyone else in the federal workforce.
We can’t let this violation of the law become the new normal. |
